{"id":2834,"date":"2023-05-15T09:42:57","date_gmt":"2023-05-15T09:42:57","guid":{"rendered":"https:\/\/alcleanscarpet.site\/Weatherby\/2023\/05\/15\/can-you-be-held-responsible-for-your-parents-nursing-home-bill\/"},"modified":"2023-06-06T08:47:30","modified_gmt":"2023-06-06T08:47:30","slug":"can-you-be-held-responsible-for-your-parents-nursing-home-bill","status":"publish","type":"post","link":"https:\/\/alcleanscarpet.site\/Weatherby\/can-you-be-held-responsible-for-your-parents-nursing-home-bill\/","title":{"rendered":"CAN YOU BE HELD RESPONSIBLE FOR YOUR PARENT\u2019S NURSING HOME BILL?"},"content":{"rendered":"<p><a href=\"http:\/\/weatherby-associates.com\/wp-content\/uploads\/2017\/04\/pexels-photo-339620.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-thumbnail wp-image-1957\" src=\"https:\/\/alcleanscarpet.site\/Weatherby\/wp-content\/uploads\/2017\/04\/pexels-photo-339620.jpeg\" alt=\"Nursing Homes \" width=\"150\" height=\"150\"><\/a><\/p>\n<p>Have you ever heard of state \u201cfilial responsibility\u201d laws?&nbsp; Although rarely enforced, 29 different states have laws that require children to provide financial support to their indigent parents under certain circumstances.&nbsp; In the context of long term care, those statutes could potentially result in adult children being liable for their parents\u2019 sizable nursing home and other care-related costs.<\/p>\n<p>Filial support laws originated all the way back from England\u2019s 16th century poor laws. &nbsp;At one time in the US, as many as 45 states made children legally responsible to support their parents if their parents lacked the financial means to support themselves.&nbsp; With the growth of state-administered Medicaid programs to pay for nursing home costs, some states repealed their filial support laws.&nbsp; However, many have NOT repealed those laws and therefore those laws remain on the books. &nbsp;Those laws then are a potential tool nursing homes could use to try to recoup costs that cannot be privately paid by their residents\u2019 insufficient assets.&nbsp;<\/p>\n<p>One case where a state filial responsibility law was used to successfully reach a child\u2019s assets to defray the cost of a parent\u2019s nursing home costs was the 2012 Pennsylvania case of <span style=\"text-decoration: underline;\">Health Care &amp; Retirement Corporation of America v. Pittas<\/span> (Pa. Super. Ct., No. 536 EDA 2011, May 7, 2012).&nbsp; After John Pittas\u2019 mother suffered an automobile accident, she spent some time rehabilitating in a nursing home.&nbsp; After her recovery, she moved back to Greece, leaving $93,000 in unpaid nursing home bills.&nbsp; Using the state\u2019s filial responsibility law, the nursing home successfully sued Mr. Pittas and he was held liable for the entire debt.&nbsp; Apparently his mother had initiated a claim for Medicaid but that claim was not yet decided at the time the nursing home brought its suit against Mr. Pittas.&nbsp; The Court clarified that under the law, the nursing home need not consider other sources of income, nor was it obligated to wait until a Medicaid decision was reached on his mother\u2019s pending Medicaid claim.&nbsp; Also unsettling was the fact that the Court made no finding that there were any fraudulent transfers or other attempts by Mr. Pittas to divert or hide his mother\u2019s assets.<\/p>\n<p>Connecticut happens to be one of those 29 states that have a filial responsibility statute.&nbsp; However, its law only applies to parents under the age of 65. &nbsp;That makes it mostly inapplicable to long-term care situations.&nbsp; But of course there is nothing stopping the state legislature from changing that statute to make it more broadly applicable. &nbsp;And in some states, if filial responsibility statutes are ever enforced, the additional penalties associated with financial liability could be incurred.&nbsp; For example, Massachusetts Laws Chapter 273, Section 20, entitled \u201cNeglect or refusal to support parent,\u201d provides a punishment of a $200 fine or up to a year in prison, or both.&nbsp; Similarly, in North Carolina a child can be guilty of a Class 2 misdemeanor on a first offense.<\/p>\n<p>Connecticut also has another statutory mechanism that could be used against the families of Medicaid applicants.&nbsp; See C.G.S. Sec. 17b-261q.&nbsp; That statute gives nursing homes the ability to sue when a penalty period is applied due to a transfer occurring within two years of filing for benefits.&nbsp; What is particularly unsettling about that law is that nursing homes are not limited to pursuing a claim against the person who made a gift.&nbsp; Rather, they can also seek to recover the debt against those who <span style=\"text-decoration: underline;\">receive<\/span> such gifts.&nbsp;<\/p>\n<p>So do we think the adult children of the seniors we work with should be particularly worried about filial responsibility laws?&nbsp; No, and yes.&nbsp; Actual cases brought by nursing homes for claims premised on filial responsibility laws have been few and far between, even if state statutes explicitly grant authority for such claims.&nbsp; Nonetheless, in recent years the Medicaid rules have changed to make it harder for nursing home residents to qualify for benefits and to avoid penalties being assessed on their benefit eligibility.&nbsp; Similarly, we have noticed a trend where it is becoming more common for nursing homes to aggressively sue residents and their family members.&nbsp; So it may only be a matter of time before litigators for nursing homes realize the potential power of going after children for unpaid care expenses through the reach of filial responsibility laws.<\/p>\n<p>Please call us at 860-769-6938 if you have any questions about the issues presented above or if you care to discuss any other planning issues with us.<\/p>\n<h2>Nursing Home Lawyers &#8211; CT<\/h2>\n<p>&nbsp;<\/p>\n<p>https:\/\/weatherby-associates.com\/can-held-responsible-parents-nursing-home-bill<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Have you ever heard of state \u201cfilial responsibility\u201d laws?&nbsp; Although rarely enforced, 29 different states have laws that require children to provide financial support to their indigent parents under certain [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-2834","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
