{"id":2860,"date":"2023-05-15T09:43:01","date_gmt":"2023-05-15T09:43:01","guid":{"rendered":"https:\/\/alcleanscarpet.site\/Weatherby\/2023\/05\/15\/special-needs-trust-in-connecticut\/"},"modified":"2023-06-06T09:06:05","modified_gmt":"2023-06-06T09:06:05","slug":"special-needs-trust-in-connecticut","status":"publish","type":"post","link":"https:\/\/alcleanscarpet.site\/Weatherby\/special-needs-trust-in-connecticut\/","title":{"rendered":"Special Needs Trust In Connecticut"},"content":{"rendered":"<p><a href=\"https:\/\/alcleanscarpet.site\/Weatherby\/wp-content\/uploads\/2016\/03\/eldrlaw-3.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-1229\" src=\"https:\/\/alcleanscarpet.site\/Weatherby\/wp-content\/uploads\/2016\/03\/eldrlaw-3.jpg\" alt=\"Special Needs Trust In Connecticut\" width=\"140\" height=\"211\" \/><\/a><\/p>\n<h2><b>Special Needs Trust \u2013 What is it?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">You may have heard the term \u201cSpecial Needs Trust\u201d before. \u00a0But do you know what it means? \u00a0What makes a Special Needs Trust different than other types of trusts? \u00a0In what sort of situation is it appropriate to have a Special Needs Trust?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A Special Needs Trust is intended to benefit someone who has a disability that is likely to cause them to rely on government benefit programs at some point. \u00a0The beneficiary may already be receiving government benefits when a trust is set up for them. \u00a0But that need not be the case. \u00a0Rather, if there is a good chance that benefits may be needed at some point in the future, a Special Needs Trust would be appropriate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The trust agreement will contain a number of requirements and restrictions on how the Trustee is allowed to use the assets for the beneficiary. \u00a0A Special Needs Trust is also commonly referred to as a \u201c<\/span><i><span style=\"font-weight: 400;\">Supplemental Needs Trust<\/span><\/i><span style=\"font-weight: 400;\">.\u201d \u00a0That term aptly describes how a Special Needs Trust should be administered. \u00a0The Trustee will only be able use the assets to \u201csupplement\u201d the benefits the beneficiary is otherwise receiving. \u00a0To put it another way, the Special Needs Trust assets must not be used to replace the governmental benefits the beneficiary is receiving. \u00a0The purpose of the Special Needs Trust is to maximize whatever government benefits the beneficiary is receiving so that the Special Needs Trust distributions help improve the quality of life for the beneficiary. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">What sorts of expenses are \u201csupplemental needs?\u201d \u00a0Think of a one time, occasional expense that would make the beneficiary\u2019s life a little better. \u00a0Examples might include a new mattress, an interactive computer learning system for an autistic child, or maybe an upgrade of a handicapped accessible vehicle. \u00a0The Special Needs Trust can pay for vacations that would otherwise not be possible. \u00a0Things like paying recurring health insurance premiums or nursing home fees would not be supplemental needs. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unfortunately it is an all too common occurrence that receiving an inheritance from a deceased loved one can be very detrimental to a beneficiary who should have had a Special Needs Trust. \u00a0When assets are left outright to them they may immediately lose their governmental benefits eligibility. \u00a0That means that they will have to spend that inheritance \u2013 possibly many thousands of dollars \u2013 on things that would otherwise have been covered by their benefit program, like health care, until the money is gone and they can then re-apply for benefits.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is not only outright bequests that are a problem. \u00a0Assets left in a trust that do not contain the right language as to the Trustee\u2019s powers can be equally dangerous. \u00a0In a typical trust that is not a Special Needs Trust the Trustee will often be directed to provide for the beneficiary\u2019s health, education, maintenance and support. \u00a0If the Trustee has these directions the trust will not qualify as a Special Needs Trust. \u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Is a Special Needs Trust a \u201ccomplicated\u201d estate planning device? Yes and no. For attorneys who have meaningful experience in the special-needs planning area it represents a very valuable planning tool for the beneficiary. What is crucial is that the trust is drafted to say precisely the right things in light of some very tricky benefit eligibility rules.
